The Grant County Board of Commissioners reminds residents of regulations related to snow dumping. It is unlawful to push snow into a road right-of-way ditch.

“One of the problems Grant County encounters during the winter is the dumping of snow in road right-of-way ditches,” stated the board. “The snow dumped in ditches blocks visibility of highway signs, damages highway snow removal equipment and collects snow on the highways.”

Dumping of snow in a road right-of-way is a violation of South Dakota law SDCL 31-32-3.1 and 31-32-7. If it becomes necessary to remove the snow dumped in a ditch, the county has the authority to recover the cost of the removal from the person dumping the snow. In addition, if the dumping of the snow in the ditch should cause damage or injury to others, the person dumping the snow will be held responsible for the damages per SDCL 31-32-8.
